Minnesota Roofing Company Seeks
Temporary Restraining Order Against Tremco

Gag Sheet Metal Inc.(GSM), New Ulm MN, filed action in the Fifth District Court seeking a temporary restraining order (TRO) and temporary injunction to prevent Independent School District (ISD) 88 from opening bids for a school roofing project. GSM’s attorney emphasized two arguments for granting the restraining order: (1) that an engineer did not prepare the plans and specifications as required by State law, (2) that Tremco’s involvement in the preparation of plans and specifications biased the project towards Tremco’s products.

A series of articles in the New Ulm Journal tracked the course of the filing for the TRO to its status as of December 31, 2016. The temporary injunction was denied, however the decision did leave the case open for possible consideration of a permanent injunction at a second hearing.
